Acknowledgement of Risks:
I, the undersigned, acknowledge and understand that participation in programs, events, and related activities organized, hosted, or operated by Elite Sports Training and Field One Performance, LLC (collectively, the "Organizations")—whether individually or jointly—(the "Activities") involves inherent risks, including but not limited to:
Injuries resulting from falls, contact with other participants, or other unforeseen accidents;
Exposure to hazardous weather conditions, including high heat, humidity, or extreme cold;
Injuries related to the use of equipment, including but not limited to, weights, batting cages, and ball machines;
Injuries resulting from physical exertion or strain, including, but not limited to, sprains, strains, broken bones, concussions, or more serious bodily harm;
The risk of injury while engaging in training or fitness activities both within and outside the facility;
Slip, trip, and fall hazards, whether inside the facility or on the surrounding premises.
Health and Fitness Assurance:
I acknowledge that I am physically and mentally capable of participating in the Activities I have chosen. I agree to promptly inform the trainers, coaches, or facility staff of any physical or psychological conditions that may affect my ability to participate or pose a risk to my health and safety.
Assumption of Risk:
By signing this waiver, I expressly assume all risk and liability for personal injury, property damage, or any other consequence resulting from participation in any Activities conducted by or in association with the Organizations. I fully understand that such risks are inherent in the nature of these Activities.
Release and Waiver of Liability:
In consideration of being allowed to participate in the Activities, I, for myself, my heirs, assigns, executors, and administrators, hereby release, waive, discharge, and covenant not to sue Elite Sports Training, Field One Performance, LLC, their respective owners, operators, employees, agents, contractors, officers, volunteers, representatives, sponsors, and all others associated with either organization or any facility used for the Activities (collectively, the "Releasees") from any and all claims, demands, damages, causes of action, or liability for any injury, death, or loss of any kind arising out of or in any way related to my participation in the Activities, including but not limited to those arising from the negligence of the Releasees.
I understand that this release applies to all injuries or damages that occur during the Activities, whether within or outside the premises, including while using any equipment, participating in any exercise, or traveling to and from the facility.
Indemnification:
I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, damages, expenses, or liabilities, including attorney’s fees, arising from my participation in the Activities or any breach of this waiver.
Social Media and Media Release:
I acknowledge and consent to the recording of photographs, videos, or other media (the “Media”) during my participation in the Activities. I grant permission to both Elite Sports Training and Field One Performance, LLC, and their affiliates, to use my image, likeness, and voice for promotional, educational, or marketing purposes, including but not limited to social media, websites, advertisements, and printed materials. I waive any right to compensation for the use of such Media.
Facility Policies:
I agree to follow all rules and guidelines set forth by the Organizations, including safety rules, equipment usage guidelines, and facility policies. I understand that failure to comply with these policies may result in immediate suspension or termination of my participation in the Activities without refund.
Severability:
If any provision of this Waiver of Liability is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment and Acceptance:
By signing below, I confirm that I have read, understood, and voluntarily agreed to all the terms of this Injury Waiver and Release of Liability. I acknowledge that I am waiving significant legal rights, including the right to sue, and that I am doing so voluntarily and of my own free will.
Parent/Guardian Consent (for Participants Under 18 Years of Age):
I, the undersigned, am the parent or legal guardian of the minor named below. I have read and understand the terms of this Injury Waiver and Release of Liability. I hereby consent to the minor's participation in the Activities organized, hosted, or operated by Elite Sports Training and Field One Performance, LLC, and agree to all terms stated above on behalf of the minor. I further agree to release, indemnify, and hold harmless the Releasees from any and all liability for any injury, loss, or damage resulting from the minor’s participation, to the fullest extent permitted by law.
